Sub: Difficulties faced by the newly formed Unit at Goa Customs - reg.
Respected Sir,
At the outset, I would like to make a brief introduction about our Federation for familiarization. The All India Federation of Superintendent of Customs was formed in the year 2000 after enactment of Central Civil Services (Recognition of Service Association) Rules, 1993 commonly known as CCS (RSA) Rules, 1993. Rule 5(c) of the said Rules states on the condition for recognition of Service Associations that
“membership of the Service Associations has been restricted to a distinct category of Government servants having common interest..”. A lot of deliberations had taken place for number of years since 1993 on the nature and shape of the ‘distinct category of Government servants having common interest’. Finally, the Board vide letter F.No. B.12014/4/93-Ad.IVA dated 20th March, 1996 prepared a cadre wise list of service associations/federations for giving recognition and directed all concerned to form Cadre Based service associations at all India level (copies enclosed for ready reference).
2. Thereafter, this Federation was formed in an All India Convention, represented by members from the Custom Houses of Mumbai, Chennai, Kolkata, Cochin and Visakhapatnam, held in Mumbai on 30th September, 2000.
3. Prior to the formation of this Federation, the Preventive officers and the Superintendents had a combined federation in the name as All India Customs Preventive Service Federation, of which the undersigned was the President for many number of years till the formation of this Federation.
4. We, on fulfillment of the stipulated conditions, as fixed by the Government of India, were given the recognition by the Govt of India, Ministry of Finance, Dept of Revenue vide letter F. No. B-12017/15/2001 Ad IV A dated 29.04.2004 (copy enclosed). All such recognized Federations/Associations were allowed to maintain its Branches/Units at the commissionerate’s/ local level (para 2 of the said Board’s letter dated 20.03.1996).
5. Some Superintendents of Goa Customs have now decided to form the local Unit/Branch of this Federation and in consultation with this Federation has named the Goa Unit/Branch as The Association of Superintendents of Customs, Goa in line with other Units at other ports.
6. It is reported by the President of the newly formed Goa Customs Unit that in spite of submission of the authorization by the new members for deduction of subscription from their salary towards the Association of Superintendents of Customs, Goa, it has not been done. Moreover, money has wrongly been deducted from their salary towards the other Association, of which they cease to be the members as soon as they have joined the new Association. As a rule any Government servant can not be member of two service Associations.
7. It is also brought to kind knowledge that no Superintendent can be a member of any Association/Federation other that of the Superintendents of Customs,
which has been notified as distinct category of Government servant. It is incorrect to allow continuing some of the Superintendents to remain as member of the Goa Customs Preventive Service Association, which is an Association of the Preventive officers, who are a different category than the Superintendents of Customs. In fact Rule 5(d)(ii) of the CCS(RSA) Rules is applicable in this case to terminate the membership of the Superintendents from the Goa Customs Preventive Service Association.
8. In view of the above, your kind intervention is solicited in the matter so that the newly formed Association of Superintendents of Customs, Goa may find administrative cooperation from Goa Customs and all matters relating to the cadre of the Superintendents from the Goa Customs may be referred to them. The subscription may also be deducted from the salary of the members, who have submitted their authorization letters to the department.
